2.- Purpose and scope of application
2.1.- This Legal Notice establishes the general conditions of use that regulate the access, browsing and use of the website https://www.genyo.es (hereinafter, WEBSITE), as well as the responsibilities derived from the use of its contents. Additionally, the provision of certain services or activities within the framework of the WEBSITE may also be subject to other specific conditions that may be established and which, where appropriate, replace, complement and/or modify the general conditions of use of this Legal Notice.
2.2.- This WEBSITE is a service that FIBAO places at the disposal of Internet users for the purposes of information and communication, and FIBAO may at any time and without prior notice make any modifications it deems appropriate to its design, configuration and content.
2.3.- Access to and use of this WEBSITE confers on the visitor the status of USER and implies full and unreserved acceptance, from said access and/or use, of each and every one of the conditions of use that FIBAO includes in this Legal Notice, in the version published at the time of accessing the same. In this sense, USER shall be understood to be the person who accesses, browses, uses or participates in the services and activities carried out on the WEBSITE.
2.4.- The USER is obliged to make correct use of the WEBSITE, in accordance with the applicable laws, good faith, public order, the uses of traffic and this Legal Notice, and shall be liable to FIBAO and to third parties for any damages that may be caused as a consequence of non-compliance with this obligation.
3.- Access and use of the WEBSITE
3.1.- Access to this WEBSITE is free of charge, except for the cost of connection to the telecommunications network supplied by the operator contracted by each USER.
3.2.- The USER assumes responsibility for the use of the WEBSITE. This responsibility extends to any registration that may be necessary to access certain services or content.
The USER undertakes to make appropriate, diligent and lawful use of the content and services that FIBAO offers through the WEBSITE, which includes, but is not limited to, not using them to:
3.3.-FIBAO reserves the right to interrupt access to the WEBSITE at any time and without prior notice, as well as to interrupt the provision of any or all of the services that are provided through it, whether for technical or security reasons, or for any other reason.
4.- Protection of personal data
4.1.- FIBAO undertakes to process personal data in a manner that respects the rights of the data subjects and in accordance with the data protection regulations in force at any given time.
4.2.- In each data collection form on the WEBSITE, basic data protection information will be made permanently available to the USER, relating to the identification of the data controller, the purposes of the processing and the rights that may be exercised by the interested party, as well as a link to additional and detailed data protection information included in the WEBSITE’s privacy policy. The express acceptance by the USER of the privacy policy by ticking the corresponding box will be necessary for the form to be considered completed and for the sending process to be completed. The content of this privacy policy may be subject to modification in order to adapt it to legislative changes that may occur, as well as to criteria and positions issued by the control authorities.

Unless expressly indicated to the contrary, the data requested on our forms are necessary in order to process your request.
4.4.- If a USER provides personal data of third parties, he/she undertakes to comply, in relation to the said communication, with all obligations deriving from the data protection regulations in force, and in particular the duties of lawfulness of the processing and the duty of transparency with regard to the owner of the personal data in relation to the communication of the same to FIBAO, exonerating and holding the latter harmless from any liability whatsoever.
4.5.- Minors under 14 years of age are not permitted to provide their personal data through the WEBSITE, and prior express authorisation from their parents or guardians is required. In any case, this WEBSITE is not aimed at minors.
5.- Intellectual and industrial property
5.1.- FIBAO, by itself or as assignee, is the owner of all the intellectual and industrial property rights of this WEBSITE, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software or texts; trademarks or logos, combinations of colours, structure and design, selection of materials used, computer programmes necessary for its operation, access and use, etc.), owned by FIBAO or its licensors. All rights reserved.
5.2.- The reproduction, distribution, transformation and public communication, including making available, of all or part of the contents of the WEBSITE for commercial purposes, in any medium and by any technical means, without the prior and express authorisation of FIBAO, is expressly prohibited without the prior and express authorisation of FIBAO.
5.3.- The USER undertakes to respect the intellectual and industrial property rights owned by FIBAO. The USER may view the elements of the WEBSITE and even print, copy and store them on the hard disk of his/her computer or on any other physical medium, provided that this is solely and exclusively for his/her personal and private use. The USER shall refrain from deleting, altering, evading or manipulating any protection device or security system installed on the WEBSITE.
6.- Exclusion of guarantees and liability
6.1.- The content of this WEBSITE is for informative purposes and for the creation of a channel of communication with the USERS, and its content may not be considered as exhaustive advice on any subject. FIBAO does not fully guarantee access to all the content, nor its completeness, correctness, validity or currency, nor its suitability or usefulness for a specific objective. FIBAO excludes, to the fullest extent permitted by law, any liability for damages of any kind arising from, including but not limited to: errors or omissions in the content, lack of availability of the WEBSITE, or the transmission of viruses or malicious or harmful programmes in the content. Nevertheless, FIBAO declares that it has adopted technical measures, within its possibilities and the state of technology, to guarantee the functioning of the WEBSITE and to avoid the existence and transmission of viruses and other harmful components to USERS.
6.2.- FIBAO shall not be held responsible for the use made by the USER of the services and content of the WEBSITE, nor for the opinions expressed by the USERS through the forums, chats, blogs or other participation tools. The USER acknowledges and accepts that the use of the WEBSITE, as well as its services and contents, is carried out at his or her exclusive risk and responsibility.
6.3.- The USER shall be solely responsible for the contributions and comments made on this WEBSITE and other participation tools, and FIBAO reserves the right to remove from this WEBSITE those which, in its opinion, it considers inappropriate for publication.
7.- Links
7.1.- In the event that the WEBSITE contains links or hyperlinks to other Internet sites, FIBAO shall not exercise any control over such sites and content. Under no circumstances shall FIBAO assume any responsibility for the content of linked external websites, nor shall it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, legality or validity of any material or information contained in any of said hyperlinks or other Internet sites. In this regard, if the USERS become aware of the unlawfulness of activities carried out through these linked third-party web pages, they must immediately notify FIBAO so that the link to them may be disabled.
7.2.- Likewise, the inclusion of any type of link by FIBAO to other Internet sites shall not imply that there exists any type of relationship, association, collaboration or dependence between FIBAO and the owner of the external web site.
8.- Right of exclusion
8.1.- FIBAO reserves the right to deny or withdraw access to the WEBSITE and/or to the content and services offered therein, without the need for prior notice, to those USERS who fail to comply with these general conditions of use or any particular conditions that may be established.
9.- General
9.1.- In the event of any discrepancy between the provisions of these general conditions of use and the particular conditions of each specific service, the provisions of the latter shall prevail.
9.2.- If any provision or content of this Legal Notice is declared null and void or inapplicable, in whole or in part, by a final decision of a competent Court or Tribunal, such nullity or inapplicability shall not affect the remaining provisions of the conditions of use, which shall remain valid for all purposes.
9.3. The non-exercise or non-execution by FIBAO of any right or provision contained in these conditions of use shall not constitute a waiver of the same, unless FIBAO acknowledges and agrees to the same in writing.
9.4.- FIBAO may modify all or part of these conditions at any time and at any time, and said modifications shall be effective from the moment of their publication on the Web Site.
10.- Applicable law and jurisdiction
The relationship established between FIBAO and the USER shall be governed by the provisions of current Spanish legislation. For the resolution of any conflict and, unless otherwise provided by law, both parties submit themselves, expressly renouncing any other jurisdiction, to the Courts and Tribunals of the city of Granada.
